Sam Smith has already agreed to pay Tom Petty songwriting royalties after similarities were spotted between 'Stay With Me' and the 1989 track 'I Won't Back Down'.
Songwriter Mark Halper has now filed a lawsuit claiming he recorded 'Don't Throw Our Love Away' in 1986 which starts with  the key phrase 'stay with me'.Â
Mark Halper is going after several record labels and instead of seeking funds is asking for a Grammy Award.Â
Speaking with Polly on The Hits Ed Sheeran said "So he said stay with me once? Leave Sam alone, Sam's had his lawsuit. Leave alone"
"I spoke to Sam and he didn't even know the Tom Petty song originally"
"1986 like it wasn't a hit mate so like stop it! Stay With Me has made people happy"Â
"All I want is a Grammy Polly, life isn't fair".Â
